
New
Penalties For DUI
1. The urine test is
not
an option when stopped for DUI unless you are suspected of drug
influence. Now the choice of chemical test is limited just to breath or
blood for regular DUI.
2. If you are convicted
of a DUI with a blood alcohol level of .20% or higher you are required
to attend a six month DUI program and extra jail time can apply.
3. If you are convicted
of a wet-reckless (a plea bargain down from original charge of DUI) you
may be required to attend an alcohol program. If you don't enroll in
the three month class, no restricted license is possible - keep this in
mind if the judge say you only have to do the 12 hour class
4. If you are convicted
of first DUI, you must get a restricted license or lose yours for six
months.
5. There are now
several new penalties for having
a blood alcohol level over .15% - judges are giving more jail time and
longer classes - if you are over .20% blood alcohol level, even longer
jail and class sentences apply.
6. Judges can make you
put a breathalyzer on your
car or automobile which will prevent the vehicle from starting if you
have been drinking - it also reports on you if you have alcohol in your
system.
7. A new device on the
market, the SCRAM device is
now available to judges - this device is a GPS and alcohol detector
which surrounds your ankle and wireless reports your blood alcohol
level by measuring your sweat - if you leave the area you are supposed
to be in, it also reports where you are and where you went - big
brother!
